Terms of Service

These terms are an agreement between you and The Night Project ("we", "us"), the operator of Ruust ("the Service"), a container hosting platform available at ruust.run. By creating an account or using the Service, you agree to these terms. If you are using Ruust for an organisation, you confirm you are authorised to accept these terms on its behalf.
1The Service
Ruust builds, deploys and runs your applications and databases (each an "Egg") on our managed infrastructure, or on your own hosts where you choose to bring your own. We provide the orchestration, ingress, TLS, private networking and the dashboard. We may change, add or remove features over time, and will give reasonable notice of any material change that adversely affects you.
2Your account
You must provide accurate account details and keep them up to date. You are responsible for the security of your credentials and for all activity under your account. Tell us promptly at [email protected] if you believe your account has been compromised.
3Acceptable use
You agree not to use the Service to:
- break any applicable law, or infringe anyone else's rights;
- host malware, phishing, or content that is unlawful or seriously harmful;
- attack, overload, probe or disrupt the Service or other customers, or attempt to gain unauthorised access to any system;
- send unsolicited bulk messaging (spam), or mine cryptocurrency on our managed fleet.
Egress is unmetered, but that is not the same as unlimited abuse: fair-use and per-Egg rate controls still apply, and we may act on sustained abnormal traffic. We may remove content or suspend an Egg that breaches this section, with notice where we reasonably can.
4Fees and billing
Paid Eggs are billed a flat monthly price in GBP, based on the size you choose (memory and vCPU, plus disk for a database Egg). Charges are collected through our payment processor. We prorate changes when you resize or retire an Egg. Prices exclude any applicable taxes, which you are responsible for. We may change prices with at least 30 days' notice; continued use after a change means you accept it.
5Your content
You own your code, data and other content. You grant us the limited licence needed to host, build, run, back up and transmit it solely to provide the Service. You are responsible for your content and confirm you have the rights to it. Keep your own backups of anything important; you are responsible for the lawfulness of what you run.
6Availability
We work hard to keep the Service available, but except where a separate written service level agreement applies, it is provided on a reasonable-efforts basis without an uptime guarantee. We may carry out maintenance, and will aim to minimise disruption.
7Suspension and termination
You can close your account at any time from the dashboard. We may suspend or terminate your access if you materially breach these terms, fail to pay, or put the Service or others at risk, giving notice where we reasonably can. On termination, your Eggs stop and your data may be deleted after a short grace period, so export anything you need first.
8Disclaimers and liability
To the extent permitted by law, the Service is provided "as is" without warranties of any kind. Nothing in these terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, or for fraud). Subject to that, we are not liable for indirect or consequential loss, or for lost profits, revenue or data, and our total liability in any 12 month period is limited to the fees you paid us in that period.
9Changes to these terms
We may update these terms from time to time. If a change is material we will give reasonable notice, for example by email or in the dashboard. The "last updated" date above shows the current version.
10Governing law and contact
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. Questions about these terms can be sent to [email protected].
